We're Under Contract With Someone Else

A contract affects timing, but it does not prevent planning or evaluating alternatives.

A contract is the cleanest objection in sales, because it arrives with a date. It is also the easiest place for a rep to abandon a qualified opportunity that will be live next year.

What they say

  • “We're under contract until next year”
  • “Can't touch it until renewal”
  • “We're locked in”

What's actually underneath it

A true constraint with a knowable expiry date

A convenient shield to end the conversation

They do not actually know their own terms

The ten questions that open it up

Ask one. Then stop talking. The answer is worth more than anything you were about to say.

  1. 1.“When does the current agreement expire?”
  2. 2.“What are the renewal and cancellation terms?”
  3. 3.“Are you satisfied enough to renew it today?”
  4. 4.“What would have to happen before you considered leaving that provider?”
  5. 5.“Does the contract guarantee performance, or does it simply guarantee payment?”
  6. 6.“What happens if the provider continues underperforming for the remainder of the term?”
  7. 7.“Is there an opportunity to begin planning now so you are not rushed at renewal?”
  8. 8.“Could our solution supplement what you already have without violating the agreement?”
  9. 9.“Who monitors whether the provider is meeting its obligations?”
  10. 10.“If you were free of the contract today, would you choose them again?”

The trap

Walking away from a dated, qualified opportunity because the calendar is inconvenient.

Sell the evaluation, not the switch, and never encourage anyone to break an agreement. Do the homework now so renewal is a decision instead of a default.
